Consent of the customer who is a natural person and processing his or her personal data are subject to
the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection
of natural persons with regard to the processing of personal data and on the free movement of such data,
and repealing Directive 95/46/EC (General Data Protection regulation) effective as of 25 May 2018 (hereinafter
also referred to only as the „Regulation“).
Personal data controller is the FOMEI Company s.r.o., Company Registration Number 46504869,
with the registered office Praha 8, U Libeňského pivovaru 2015/10, Postal Code 18000, entered in the Commercial
Register maintained by the Municipal Court in Prague, Section C, Entry 275265 (hereinafter also referred
to only as the “Controller“).
The Controller warns that sending information and marketing messages (see letter a) below) is
not intended for natural persons (i.e. people) younger than 16 years of age.
Natural person (i.e. person) giving his or her consent to the under mentioned is well
aware of this fact and declares that he or she is older than 16 years of age and swears
that such declaration is true. If the declaration proves to be false, the Controller is entitled to terminate
sending information and marketing messages without notice.
Natural person (i.e. person) as the subject of the personal data given within registration,
i.e. e-mail contact or his/her name and/or family name and/or any other personal information included
in the e-mail contact, gives his/her consent to the Controller to process the above mentioned data for
the below mentioned purpose by his/her free and voluntary decision made by hitting the
“Register” button in connection with hitting the “Send” button after the relevant news field/fields has/have
been chosen:
a) For the purpose of sending information and marketing messages (“Newsletters” from
the area/areas the customer has chosen are sent to the customer by e-mail).
Personal data are processed by the Controller for the aforementioned purposes subject to giving consent.
Consent is voluntary and not giving consent to personal data processing shall have no effect on either
concluding or performing of contractual relationship with the Controller.
Consent to personal data processing is given for indefinite period of time. Natural person
(i.e. person) as the data subject is aware that he/she has the right to withdraw the consent to
personal data processing anytime. Consent can be withdrawn:
in every sent “Newsletter”, which contains the option to cancel sending of these or to change the customer’s
preferences in the footer.
Legitimacy of personal data processing based on the consent given before its withdrawal is not prejudiced
by withdrawing the consent. Withdrawing the consent given for a specific purpose does not mean the Controller
cannot process the data for another purpose (if the consent has been given) or for a legal reason in accordance
with article 6 letter 1 of the Regulation other than the consent. Natural person (i.e. person) as the
data subject is aware that even after the consent has been withdrawn the Controller has the right to process
personal data within the scope necessary for the purposes of performing the contract (e.g. ordered goods
delivery)) and/or performing the Controller’s legal obligations (e.g. accounting or tax related) and/or
for protecting justified interests of the Controller or a third party (e.g. when exercising its rights
and justified interests before courts and other public authorities, and also in order to give evidence
that the customer’s consent to processing certain data has been given).
The Controller provides or can provide personal data to:
FOMEI SLOVAKIA, s.r.o., subsidiary company of the Controller, which operates, either directly on its behalf
and its account and also on the Collector’s behalf and its account, in the territory of the Slovak Republic;
contractual partners of the Controller, especially subjects providing the Controller with the customer
related services, or subjects providing or coordinating sending messages, etc.;
public authorities or other subjects performing their statutory obligations specified by special regulations,
especially administrative agencies, courts, supervisory authorities, etc.;
other subjects if necessary in order to protect the Controller’s rights, e.g. legal representatives, tax
consultants, etc.
Processing is performed in the Controller’s registered office or its business premises by the individual
authorized employees of the Controller or by other processors. Data are processed automatically using
IT technologies and also manually while observing controlling, technical and security mechanisms to guarantee
the highest possible protection of the processed data against unauthorized access or transmission, loss
or destruction, or other abuse.
All subjects who can get access to personal data respect the right for privacy protection and they are
obliged to proceed in accordance with the existing legal regulations concerning personal data protection
under the law or contracts concluded with the Controller.
Natural person (i.e. person) as the data subject has the right to request the Controller the access to
personal data, their amendment or erasure, or restrictions applied to processing, and also the right to
object to the processing, as well as the right to data transmission.
Natural person (i.e. person) as the data subject has the right to lodge a complaint with the supervisory
authority, which is the Office for Personal Data Protection with the registered office at Pplk. Sochora
